Department of Defense funds and facilities may not be used to perform abortions, except when carrying the fetus to term would endanger the mother’s life or the pregnancy resulted from rape or incest.
(a) Funds. Department of Defense funds may not be used to perform an abortion unless the mother’s life would be endangered if the fetus were carried to term, or the pregnancy resulted from rape or incest.
(b) Facilities. A Department of Defense medical treatment facility or other facility may not be used to perform an abortion unless one of those same exceptions applies.
Funds available to the Department of Defense may not be used to perform abortions except where the life of the mother would be endangered if the fetus were carried to term or in a case in which the pregnancy is the result of an act of rape or incest.
