10 U.S.C. § 1100 — Defense Health Program Account

(a) Establishment of Account. (1) The Department of Defense must establish an account called the “Defense Health Program Account.” All money appropriated to carry out the Secretary of Defense’s functions concerning the Department’s medical and health-care programs must be appropriated to this account. (2) Of the total amount appropriated for a fiscal year for programs and activities under this chapter, an amount equal to three percent of that total remains available for obligation until the end of the following fiscal year. (b) Obligation of Amounts From Account by Secretary of Defense. The Secretary of Defense may obligate or spend money from the account for programs and activities under this chapter, including contracts under sections 1079, 1086, 1092, or 1097, to the extent money is available in the account. (c) Regulations. The Secretary of Defense must issue regulations to carry out this section.
