10 U.S.C. § 14112Dissemination of names of officers selected

submitted 32 years ago by Pub. L. 103-337 to r/title-10-ARMED-FORCES · 256 words · no verdicts yet

in plain englishAI-generated · not legal advice

This section sets when a promotion board's selected names can be released to the armed force. Lower-grade names can go out once sent to the President; higher-grade names, once the President approves. Names not yet released go out once the Senate confirms, or the President approves if no confirmation is needed.

(a) Time for Dissemination. Names of officers a selection board recommends for promotion can be shared with the armed force at different points, depending on the grade: (1) for officers recommended for a grade below brigadier general or rear admiral (lower half), the names may be shared as soon as the report goes to the President, or any time after; (2) for officers recommended for a grade above colonel (or, in the Navy, above captain), the names may be shared once the President approves the report, or any time after; and (3) for any names not yet shared under (1) or (2), they must be shared promptly once the Senate confirms the promotion (if Senate confirmation is required) or once the President approves the report (if Senate confirmation isn't required). (b) Names Not Disseminated. A list of shared names cannot include: any name the President removed from the board's report, if the sharing happens under the authority described in (a)(2) or (a)(3)(B); or the name of any officer whose promotion the Senate refused to confirm, if the sharing happens under the authority described in (a)(3)(A).
