10 U.S.C. § 1486 — Other citizens of United States

(a) If local commercial mortuary services or supplies are unavailable, or the Secretary believes their cost is prohibitive, the Secretary may provide them on a reimbursable basis for these U.S. citizens who die outside the United States: (1) an employee of a humanitarian agency accredited to the armed forces, such as the American Red Cross or United Services Organization; (2) a civilian directly serving the Secretary through employment by an agency under contract with the Secretary; (3) an officer or crew member of a merchant vessel operated by or for the United States through the Secretary; (4) a person on duty with an armed force under the Secretary’s jurisdiction who is paid from nonappropriated funds; (5) a person not otherwise covered, if the Department of State specifically requests it; and (6) a dependent of a covered person who is living outside the United States with that person when the death occurs. (b) The Secretary may provide reimbursable transportation of covered remains to a U.S. port of entry. (c) Reimbursements for services, supplies, and transportation must be collected and credited to the appropriations available when reimbursement is made for those items.
