10 U.S.C. § 15101 — Officers in designated competitive categories

(a) Authority to designate competitive categories of officers: Each Secretary of a military department may name one or more "competitive categories" of officers under section 14005. Officers in a named category then have their promotion, retirement, and continued reserve status governed by this chapter instead of the usual rules. (b) Limitation on exercise of authority: The Secretary cannot name a competitive category until 60 days after sending a report about it to the Senate and House Armed Services Committees. That report must include: (1) a detailed description of what the category's officers are required to do; (2) an explanation of how many chances officers in the category get to be considered for promotion to each grade, and an estimate of when those promotions would happen; (3) an estimate of how large the promotion zone will be for each grade in the category; and (4) a description of anything else the Secretary considered in creating the category.
