The military departments must provide a confidential process for service members to challenge a discharge or separation affected by a sex-related offense.
(a) Each military-department Secretary must establish a confidential process using the department’s correction boards. A person who was, or alleges being, a victim of a sex-related offense during service may challenge the terms or characterization of the discharge or separation on the ground that the offense affected them. (b) In deciding whether to change the discharge or separation, the boards must consider (1) the psychological and physical aspects of the person’s experience and (2) how that experience may have affected the circumstances of the discharge or separation. (c) Documents and decisions from this process must not be made public without the person’s consent. (d) “Sex-related offense” means: (1) rape or sexual assault under section 920(a) or (b) (article 120 of the Uniform Code of Military Justice); (2) forcible sodomy under section 925 (article 125); or (3) an attempt to commit an offense in paragraph (1) or (2), punishable under section 880 (article 80).
The Secretaries of the military departments* shall each establish a confidential process, utilizing boards of the military department concerned established in accordance with this chapter, by which an individual who was the victim of a sex-related offense, or alleges that the individual was the victim of a sex-related offense, during service in the armed forces* may challenge the terms or characterization of the discharge or separation of the individual from the armed forces on the grounds that the terms or characterization were adversely affected by the individual being the victim of a sex-related offense.
In deciding whether to modify the terms or characterization of the discharge or separation from the armed forces of an individual described in subsection (a), the Secretary of the military department concerned shall instruct boards of the military department concerned established in accordance with this chapter—
to give due consideration to the psychological and physical aspects of the individual’s experience in connection with the sex-related offense; and
to determine what bearing such experience may have had on the circumstances surrounding the individual’s discharge or separation from the armed forces.
Documents considered and decisions rendered pursuant to the process required by subsection (a) shall not be made available to the public, except with the consent of the individual concerned.
In this section, the term “sex-related offense” means any of the following:
Rape or sexual assault under subsection (a) or (b) of section 920 of this title (article 120 of the Uniform Code of Military Justice).
Forcible sodomy under section 925 of this title (article 125 of the Uniform Code of Military Justice).
