10 U.S.C. § 20103 — Members not on sustained duty: agreements concerning conditions of service

(a) Agreements — The Secretary of the Air Force can make a written agreement with a Space Force member who isn't on sustained duty. The agreement can: (1) require the member to serve on active duty for a set period; (2) spell out the conditions of that active-duty service; and (3) for a member in space force inactive status, spell out the conditions of the member's continued service, including whether they can be ordered to active duty with or without their consent. (b) Conditions of Service — Any agreement under (a) must state its conditions of service. The Secretary of the Air Force must write regulations establishing: (1) what conditions can go in the agreement; (2) what each side owes the other; and (3) what happens if either side fails to follow the agreement's terms. (c) Authority for Retention on Active Duty During War or National Emergency — If a member's agreed active-duty period under (a) ends while a war or a national emergency declared by Congress or the President is underway, the member can be kept on active duty without their consent, the same as the law otherwise allows.
