10 U.S.C. § 239d — Budgeting for depot and ammunition production facility maintenance and repair: annual report

(a) Annual Report: Along with each year's defense budget materials, the Secretary of Defense, working with the secretaries of the military departments, must include a report on maintaining and repairing covered facilities. (b) Elements: Each report, broken down by military department, must include at least: revenue data, for each of the prior three fiscal years, for maintenance, repair, and overhaul work funded at all the department's depots; for the current budget year and the two years before it, the amount budgeted for depots, broken down by appropriation type; the amount budgeted for working-capital fund investment in depot capital budgets, broken down by whether it targets facility efficiency, work environment, equipment, non-capital equipment programs, or processes; the total amount required to be invested in covered depots' capital budgets under section 2476(a) of this title; a comparison between the budgeted amount and that required amount; and, for each covered depot, what share of the required total is allocated, or expected to be allocated, to it that year. For each covered facility, the report must also give the average facility condition, critical facility condition, maintenance backlog, and average equipment age, including how these have changed, and the status of implementing Department of Defense plans and strategies to improve the facility, including a strategy required under section 359 of the National Defense Authorization Act for Fiscal Year 2020. (c) Definitions: "Ammunition production facility" means an ammunition organic industrial base production facility. "Budget" and "defense budget materials" have the meanings given in section 234 of this title. "Covered depot" has the meaning given in section 2476 of this title. "Covered facility" means a covered depot or an ammunition production facility.
