The Secretary concerned may temporarily accept communications equipment and related services from local public-safety agencies for disaster response, subject to regulations and limits. Providers of accepted services do not thereby become United States officers, employees, or agents.

(a) Authority to accept equipment. (1) Subject to subsection (c), the Secretary concerned may accept communications equipment for coordinating joint response and recovery with public-safety agencies during a disaster, and may accept services for operating and maintaining that equipment.

(b) Regulations. The Secretary of Defense must prescribe regulations for using this authority.

(c) Limitations. (1) Equipment may be accepted only as far as equipment under the Secretary concerned’s control at the possible disaster site is not enough for military communication needs during the response. (2) Related services may be accepted only as far as the needed capabilities are not available to the military commander who has custody of the equipment.

(d) Liability. A person who provides accepted services does not become a United States officer, employee, or agent merely because the person provides those services.
