Except for treaty-required changes, the President must begin a Nuclear Posture Review before unilaterally changing the United States nuclear stockpile or deployed nuclear weapons by more than 20 percent. The review’s reference terms go to Congress, and the completed review must be submitted before the change.

(a) In General. Except for a change required by a treaty to which the Senate gave advice and consent under Article II, section 2 of the Constitution, if the President is considering unilaterally changing the total United States nuclear-weapons stockpile or the total number of deployed nuclear weapons by more than 20 percent, the President must begin a Nuclear Posture Review before making the change. The section does not define the quoted term “deployed nuclear weapons”; it refers to its definition under the New START Treaty. (b) Terms of Reference. Before beginning a review under this section, the President must set the review’s terms of reference and provide them to the congressional defense committees. (c) Nuclear Posture Review. After completing the review, the President must submit it to the congressional defense committees before implementing a change described in subsection (a). (d) Construction. This section does not apply to stockpile changes resulting from obligations under a treaty to which the Senate gave advice and consent under Article II, section 2 of the Constitution. (e) Form. The review must be submitted in unclassified form but may include a classified annex. (f) New START Treaty Defined. “New START Treaty” means the treaty between the United States and Russian Federation on further reducing and limiting strategic offensive arms, signed April 8, 2010, and effective February 5, 2011.
