10 U.S.C. § 639 — Continuation on active duty to complete disciplinary action

If a court-martial case has begun against an officer who would otherwise be separated or retired under this chapter, the military-department Secretary may delay that separation or retirement. The delay may last until the case is finished.
If an action has begun to try an officer* by court-martial, and the officer would otherwise be separated or retired under this chapter, the Secretary of the military department concerned may delay the separation or retirement. The delay does not harm or cancel the court-martial action and may continue until that action is complete.
When any action has been commenced against an officer* with a view to trying such officer by court-martial and such officer is to be separated or retired in accordance with this chapter, the Secretary of the military department concerned may delay the separation or retirement of the officer, without prejudice to such action, until the completion of the action.
