10 U.S.C. § 8225 — Female members: congressional review period for assignment to duty on submarines or for reconfiguration of submarines
submitted 26 years ago by Pub. L. 106-398 to r/title-10-ARMED-FORCES · 182 words · no verdicts yet
The Navy cannot change its rule about women on submarines, or redesign submarines for women, without first giving Congress 30 days' notice. Congress must be in continuous session during that waiting period.
(a) The Department of the Navy cannot let any change take effect to its policy (as it stood on May 10, 2000) limiting submarine service to men only, until two things happen: (1) the Secretary of Defense sends Congress written notice of the proposed change; and (2) 30 days of continuous congressional session pass after Congress receives that notice, not counting any day when either the House or Senate is not in session.
(b) The Department of the Navy cannot spend any of its money to reconfigure an existing submarine, or to design a new one, so that it can hold female crew members, until the same two steps happen: (1) the Secretary of Defense sends Congress written notice of the proposed reconfiguration or design; and (2) the same 30-day continuous session period passes.
(c) For this section, a session of Congress only counts as broken (no longer continuous) when Congress adjourns "sine die" — meaning it ends its session completely, without setting a date to reconvene.
No change in the Department of the Navy policy limiting service on submarines to males, as in effect on May 10, 2000, may take effect until—
the Secretary of Defense submits to Congress written notice of the proposed change; and
a period of 30 days of continuous session of Congress (excluding any day on which either House of Congress is not in session) expires following the date on which the notice is received.
No funds available to the Department of the Navy may be expended to reconfigure any existing submarine, or to design any new submarine, to accommodate female crew members until—
the Secretary of Defense submits to Congress written notice of the proposed reconfiguration or design; and
a period of 30 days of continuous session of Congress (excluding any day on which either House of Congress is not in session) expires following the date on which the notice is received.
For purposes of this section, the continuity of a session of Congress is broken only by an adjournment of the Congress sine die.
