Retired enlisted Navy and Marine Corps members can be promoted while on active duty. When released, they generally keep the grade or rating held at release unless another law gives them a higher one.
While on active duty*, a retired enlisted member* of the Navy or Marine Corps is eligible for promotion to a higher enlisted grade* or rating*. When released from active duty, the member must retain the grade or rating held at release unless another law entitles the member to a higher grade.
When on active duty*, retired enlisted members of the Navy or the Marine Corps are eligible for promotion to higher enlisted grades or ratings. When released from active duty, they shall, unless entitled to a higher grade* under another provision of law, retain the grades or ratings they hold at the time of their release.
