The Department of the Navy must safeguard a deceased naval-service member’s money and personal property and try to locate heirs or next of kin. Unclaimed property is sold after two years, while supported claims may be sent to Congress for consideration within five years after the proceeds reach the Treasury.
(a) If the Navy Department holds money or other personal property belonging to a deceased naval-service member, the Navy Secretary must keep it safe and diligently try to identify and locate the member’s heirs or next of kin. Property still unclaimed two years after death must be sold. The sale proceeds and any held money must be deposited in the Treasury. (b) Within five years after the money and proceeds are deposited in the Treasury, any claim presented with competent proof must be certified to Congress for consideration. (c) The Secretary must issue regulations to administer this section.
If money or other personal property of a deceased member of the naval service is in the custody of the Department of the Navy, the Secretary of the Navy shall keep it in safe custody and make a diligent effort to determine and locate the heirs or next of kin of the deceased member. Property remaining unclaimed two years after the death of the member shall be sold, and the proceeds, together with any of his money held in custody, shall be covered into the Treasury.
Within five years after the date the money and proceeds are covered into the Treasury, any claim that is presented therefor supported by competent proof shall be certified to Congress for consideration.
The Secretary shall prescribe regulations for the administration of this section.
