The Secretary of the Navy can treat appropriated money for certain Naval Academy athletic programs as nonappropriated funds. That designated money stays available until spent and follows nonappropriated-fund rules. This applies only to programs that mix appropriated and nonappropriated support and aren't private organizations.

(a) Authority. For a Naval Academy mixed-funded athletic or recreational extracurricular program, the Secretary of the Navy may designate funds appropriated to the Department of the Navy and available for that program to be treated as nonappropriated funds, spent following the laws that apply to nonappropriated funds. Appropriated funds designated this way count as nonappropriated funds for all purposes and stay available until spent. (b) Covered Programs. In this section, a "Naval Academy mixed-funded athletic or recreational extracurricular program" is an athletic or recreational extracurricular program of the Naval Academy where: (1) the program is not considered a morale, welfare, or recreation program; (2) the program is supported through appropriated funds; (3) the program is also supported by a nonappropriated fund instrumentality; and (4) the program is not, and is not operated by, a private organization.
