10 U.S.C. § 8689 — Requirements for availability of funds relating to advanced naval nuclear fuel systems based on low-enriched uranium

(a) Authorization — Low-enriched uranium activities can only use money authorized or made available to the Department of Energy for atomic energy defense activities under "defense nuclear nonproliferation." (b) Prohibition Regarding Certain Accounts — (1) None of the funds described in (2) can be spent on low-enriched uranium activities. (2) Those funds are money authorized or made available for any fiscal year for: (A) Shipbuilding and Conversion, Navy, or any other Defense Department account; or (B) any Department of Energy atomic-energy-defense account other than defense nuclear nonproliferation. (3) This prohibition can only be overridden by a law that specifically supersedes, repeals, or modifies this section. A funding law — even one with a table listing these accounts — that appropriates money from those accounts for low-enriched uranium activities does not override this section unless it specifically cites this section. (c) Low-enriched Uranium Activities Defined — "Low-enriched uranium activities" means: (1) planning or doing research and development on an advanced naval nuclear fuel system based on low-enriched uranium; and (2) procuring ships that use low-enriched uranium in their naval nuclear propulsion reactors.
