10 U.S.C. § 8725 — Acquisition by condemnation and purchase

The Secretary may buy or condemn private land near the naval petroleum reserves when other deals fail. Purchases and condemnations need the President's approval first. The Secretary must report every proceeding to Congress each year.
(a) Sometimes the Secretary* cannot work out a satisfactory land exchange or conservation agreement under section 8724. When that happens, the Secretary may acquire privately owned land and leases, but only with the President's approval. The Secretary can do this two ways: (1) by purchase, either inside the naval petroleum reserves* or outside them on the same underground geologic structure; and (2) by condemnation, either inside Naval Petroleum* Reserve Numbered 1, or outside it on the same structure if there is substantial drainage of oil away from the reserve.
(b) The Secretary must report to Congress every year on all purchase and condemnation proceedings carried out under this section.
Whenever the Secretary* is unable to make arrangements he considers satisfactory for exchanges of land or agreements for conservation authorized by section 8724 of this title, the Secretary may acquire, with the approval of the President, such privately owned lands and leases—
by purchase, inside the naval petroleum reserves*, or outside those reserves on the same geologic structure; and
by condemnation, inside Naval Petroleum* Reserve Numbered 1, or, if there is substantial drainage, outside that reserve on the same geologic structure.
The Secretary shall report annually to Congress all proceedings for purchase and condemnation under this section.
