A person subject to this chapter commits an offense by improperly acting for favorable treatment from wartime enemy captors in a way that harms other prisoners, or by unjustifiably mistreating prisoners while in authority over them. A court-martial sets the punishment.
A person subject to this chapter who, while held by the enemy during wartime—
(1) acts without proper authority, to obtain favorable treatment from captors, in a way contrary to law, custom, or regulation and harmful to other people of any nationality whom the enemy holds as civilian or military prisoners; or
(2) while having authority over those people, mistreats them without a justifiable reason;
must be punished as a court-martial directs.
Any person subject to this chapter who, while in the hands of the enemy in time of war—
for the purpose of securing favorable treatment by his captors acts without proper authority in a manner contrary to law, custom, or regulation, to the detriment of others of whatever nationality held by the enemy as civilian or military prisoners; or
while in a position of authority over such persons maltreats them without justifiable cause;
shall be punished as a court-martial may direct.
