13 U.S.C. § 401 — Exchange of census information with Bureau of Economic Analysis

The Census Bureau must share business-enterprise data it collects with the Bureau of Economic Analysis, if the Commerce Secretary decides it will improve data required under the International Investment and Trade in Services Survey Act. Only data collected directly from respondents by the Census Bureau may be shared. Requests for this data must be in writing, certifying it will be used only to improve statistics under that Act.
(a) Exchange of Information. The Bureau of the Census must share with the Bureau of Economic Analysis (part of the Department of Commerce) information it collected under title 13 and under the International Investment and Trade in Services Survey Act — but only information about a business enterprise operating in the United States, and only if the Secretary of Commerce decides that sharing it will help improve the quality of data collected under that Act. The Bureau of the Census may share only data it collected directly from the people or businesses who responded to its surveys.
(b) Requests for Information. When the Bureau of Economic Analysis's Director asks for information under this section, the request must be in writing. The Director must certify that the Bureau will use the information only for statistical work that improves data collected under title 13 and under the International Investment and Trade in Services Survey Act.
(c) Definition. In subsection (a), "business enterprise" and "United States" have the same meanings given to them in section 3 of the International Investment and Trade in Services Survey Act.
The Bureau of the Census shall exchange with the Bureau of Economic Analysis of the Department of Commerce information collected under this title, and under the International Investment and Trade in Services Survey Act, that pertains to any business enterprise that is operating in the United States, if the Secretary of Commerce determines such information is appropriate to augment and improve the quality of data collected under the International Investment and Trade in Services Survey Act. Information provided to the Bureau of Economic Analysis by the Bureau of the Census shall be only those data collected directly from respondents by the Bureau of the Census.
The Director of the Bureau requesting information under this section shall make the request in writing and shall certify that the information will be used only for statistical activities performed to improve the quality of data collected under the authority of title 13, United States Code, and the International Investment and Trade in Services Survey Act.
As used in subsection (a), the terms “business enterprise” and “United States” have the meanings given those terms in section 3 of the International Investment and Trade in Services Survey Act.
