submitted 63 years ago by Pub. L. 88-130 to r/title-14-COAST-GUARD · 117 words · no verdicts yet
A Regular Coast Guard lieutenant (junior grade) who fails twice to be selected for promotion to lieutenant must be honorably discharged, unless the officer requests an earlier discharge or qualifies for retirement. The retirement date is the date specified for discharge.
Each Regular Coast Guard officer appointed under section 2101 who is serving as a lieutenant (junior grade) and has failed twice to be selected for promotion to lieutenant must—
(1) be honorably discharged on June 30 of the promotion year in which the second failure occurs;
(2) if the officer asks, be honorably discharged earlier, without losing benefits that would have accrued if the officer had been discharged on the date in clause (1); or
(3) if eligible for retirement under any law on the specified discharge date, be retired on that date.
Each officer of the Regular Coast Guard appointed under section 2101 of this title who is serving in the grade of lieutenant (junior grade) and who has failed of selection for promotion to the grade of lieutenant for the second time, shall:
be honorably discharged on June 30 of the promotion year in which his second failure of selection occurs; or
if he so requests, be honorably discharged at an earlier date without loss of benefits that would accrue if he were discharged on that date under clause (1); or
if, on the date specified for his discharge in this section, he is eligible for retirement under any law, be retired on that date.
