submitted 63 years ago by Pub. L. 88-130 to r/title-14-COAST-GUARD · 471 words · no verdicts yet
A Regular Coast Guard lieutenant who twice fails selection for lieutenant commander must be discharged or retired under specified rules. The Secretary may continue selected officers on active duty for two to four years, after which discharge or retirement rules apply.
(a) A Regular Coast Guard officer appointed under section 2101 who is serving as a lieutenant and has failed twice to be selected for promotion to lieutenant commander must—
(1) be honorably discharged on June 30 of the promotion year in which the second failure occurs;
(2) if the officer asks, be honorably discharged earlier, without losing benefits that would have accrued if discharged on the date in clause (1);
(3) if, on the specified discharge date, the officer has at least 20 years of active service or is eligible for retirement under any law, be retired on that date; or
(4) if, on the date in clause (1), the officer has at least 18 years of active service, remain on active duty and be retired on the last day of the month in which the officer reaches 20 years of active service, unless removed earlier under another law.
(b)(1) When service needs require it, the Secretary* may direct a selection board convened under section 2106 to recommend a designated number of lieutenant officers for continuation on active duty for terms of at least two and no more than four years. These must be officers who otherwise would be discharged or retired under this section. When directed, the board must recommend the officers under consideration whom it believes are best qualified for continuation. With the Secretary’s approval, each recommended officer may remain on active duty for the recommended term despite subsection (a).
(2) When a term under paragraph (1) ends, the officer must, unless selected for another continuation—
(A) be honorably discharged with separation pay calculated under section 2146;
(B) if the officer has at least 18 years of active service on the discharge date under subparagraph (A), remain on active duty and be retired on the last day of the month in which the officer reaches 20 years of active service, unless removed earlier under another law; or
(C) if, on the specified discharge date, the officer has at least 20 years of active service or is eligible for retirement under any law, be retired on that date.
(c) An officer continued on active duty under subsection (b) must, unless removed earlier from active duty, be retired on the last day of the month in which the officer completes 20 years of active service.
Each officer of the Regular Coast Guard appointed under section 2101 of this title who is serving in the grade of lieutenant and who has failed of selection for promotion to the grade of lieutenant commander for the second time shall:
be honorably discharged on June 30 of the promotion year in which his second failure of selection occurs; or
if he so requests, be honorably discharged at an earlier date without loss of benefits that would accrue if he were discharged on that date under clause (1); or
if, on the date specified for his discharge in this section, he has completed at least 20 years of active service or is eligible for retirement under any law, be retired on that date; or
if, on the date specified for his discharge in clause (1), he has completed at least eighteen years of active service, be retained on active duty and retired on the last day of the month in which he completes twenty years of active service, unless earlier removed under another provision of law.
When the needs of the service require, the Secretary* may direct a selection board, which has been convened under section 2106 of this title, to recommend for continuation on active duty for terms of not less than two nor more than four years a designated number of officers of the grade of lieutenant who would otherwise be discharged or retired under this section. When so directed, the board shall recommend for continuation on active duty those officers under consideration who are, in the opinion of the board, best qualified for continuation. Each officer so recommended may, with the approval of the Secretary, and notwithstanding subsection (a), be continued on active duty for the term recommended.
Upon the completion of a term under paragraph (1), an officer shall, unless selected for further continuation—
except as provided in subparagraph (B), be honorably discharged with separation pay computed under section 2146 of this title;
in the case of an officer who has completed at least 18 years of active service on the date of discharge under subparagraph (A), be retained on active duty and retired on the last day of the month in which the officer completes 20 years of active service, unless earlier removed under another provision of law; or
if, on the date specified for the officer’s discharge under this section, the officer has completed at least 20 years of active service or is eligible for retirement under any law, be retired on that date.
Each officer who has been continued on active duty under subsection (b) shall, unless earlier removed from active duty, be retired on the last day of the month in which he completes twenty years of active service.
