14 U.S.C. § 334 — National Coast Guard Museum
submitted 22 years ago by Pub. L. 108-293 to r/title-14-COAST-GUARD · 588 words · no verdicts yet
The Coast Guard Commandant may establish and run a National Coast Guard Museum on federal land in New London, Connecticut. The Coast Guard can spend money on designing and building it, and a nonprofit called the Association can construct it, raise funds, and later transfer it to the government once it's built to code and paid for. The Commandant must give Congress a funding plan first, and this is the only way a Coast Guard museum may be created.
(a) Establishment — The Commandant* may establish, accept, run, maintain, and support the Museum on federally owned land in New London, Connecticut, administered by the Coast Guard.
(b) Use of Funds — The Secretary* may spend Coast Guard funds on (1) designing the Museum; (2) engineering, construction, construction management, and quality-assurance work, including work the Association does; and (3) giving federal financial help to the Association for the activities in (d).
(c) Funding Plan — Within 2 years of the Elijah E. Cummings Coast Guard Authorization Act of 2020 becoming law, and at least 90 days before accepting the Museum under (f), the Commandant must send Congress's Senate Commerce Committee and House Transportation Committee a plan covering: (1) estimated planning, engineering, design, construction, operating, and maintenance costs; (2) how much appropriated, non-appropriated, and non-federal money will be used, including any funding shortfall; (3) any environmental cleanup issues on the site; and (4) an independent, qualified certification that the cost estimates are reasonable and realistic.
(d) Construction
(1) The Association may build the Museum.
(2) It must be built to the 2018 International Building Code, and construction on federal land is exempt from state and local building or demolition permit rules.
(e) Agreements — Until the Commandant formally accepts the Museum under (f), and despite section 504, the Commandant may (1) license federal land to the Association to build the Museum, and (2)(A) lease the finished Museum back from the Association at a nominal charge for Museum activities, and (B) let the Association earn revenue from using the Museum.
(f) Acceptance — No sooner than 90 days after the Commandant submits the plan under (c), the Commandant must accept the Museum, and full ownership passes to the United States, once (1) the Association shows, to the Commandant's satisfaction, that the Museum meets the construction requirements of (d), and (2) all of the Association's financial obligations related to the Museum are paid off.
(g) Services — For activities the Secretary can fund under (b), or for maintaining or running the Museum, the Secretary may (1) request and accept services from any entity, and (2) sign contracts or agreements to get those services.
(h) Authority — The Commandant may not create a Coast Guard museum any other way than under this section.
