15 U.S.C. § 1821 — Definitions

As used in this chapter, unless the context requires otherwise: (1) “Management” means any person who organizes, controls, or administers, or who is responsible for organizing, directing, or administering. This section does not otherwise define “person.” (2) “Secretary” means the Secretary of Agriculture. (3) “Sore,” when used to describe a horse, means any of the following: (A) A person applied an irritating or blistering agent internally or externally to any limb of the horse. (B) A person inflicted a burn, cut, or laceration on any limb of the horse. (C) A person injected any tack, nail, screw, or chemical agent into any limb of the horse, or used one on any limb. (D) A person used any other substance or device on any limb of the horse, or engaged in a practice involving the horse, and because of that application, injury, injection, use, or practice, the horse suffers, or can reasonably be expected to suffer, physical pain or distress, inflammation, or lameness when walking, trotting, or otherwise moving. However, “sore” does not include an application, injury, injection, use, or practice connected with therapeutic treatment of a horse by, or under the supervision of, a person licensed to practice veterinary medicine in the State where the treatment occurred. This section does not define “therapeutic treatment,” “person,” or “veterinary medicine.” (4) “State” means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, or the Trust Territory of the Pacific Islands.
