This section defines three terms used in the contact lens chapter. 'Contact lens fitting' covers the exam-to-fit process, including specification checks, a fit check, and follow-ups. It also defines 'prescriber' and lists what a valid prescription must include.
As used in this chapter:
(1) Contact lens fitting: This is the process that starts after the initial eye exam and ends when the lens fits well — or, for a renewal prescription, ends when the prescriber decides no change is needed. It can include:
(A) an exam to figure out the lens specifications;
(B) except for a renewal, an initial check of how the lens fits on the eye; and
(C) medically necessary follow-up exams.
(2) Prescriber: This means, for contact lens prescriptions, an ophthalmologist, optometrist, or anyone else state law allows to write contact lens prescriptions, as long as they follow any applicable Food and Drug Administration* requirements.
(3) Contact lens prescription: This means a prescription, written following state and federal law, with enough information to fill it completely and correctly. It must include:
(A) the patient's name;
(B) the date of the exam;
(C) the prescription's issue date and expiration date;
(D) the prescriber's name, mailing address, phone number, and fax number;
(E) the power, and the material or manufacturer, or both;
(F) the base curve or the appropriate way of describing it;
(G) the diameter, when that matters; and
(H) for a private-label lens, the manufacturer's name, the private-label brand's trade name, and, if there is one, the equivalent brand name.
As used in this chapter:
The term “contact lens fitting” means the process that begins after the initial eye examination and ends when a successful fit has been achieved or, in the case of a renewal prescription, ends when the prescriber determines that no change in prescription is required, and such term may include—
an examination to determine lens specifications;
except in the case of a renewal of a prescription, an initial evaluation of the fit of the lens on the eye; and
medically necessary follow up examinations.
The term “prescriber” means, with respect to contact lens prescriptions, an ophthalmologist, optometrist, or other person permitted under State law to issue prescriptions for contact lenses in compliance with any applicable requirements established by the Food and Drug Administration*.
The term “contact lens prescription” means a prescription, issued in accordance with State and Federal law, that contains sufficient information for the complete and accurate filling of a prescription, including the following:
Name of the patient.
Date of examination.
Issue date and expiration date of prescription.
Name, postal address, telephone number, and facsimile telephone number of prescriber.
Power, material or manufacturer or both.
Base curve or appropriate designation.
Diameter, when appropriate.
In the case of a private label contact lens, name of manufacturer, trade name of private label brand, and, if applicable, trade name of equivalent brand name.
