The Secretary must generally allow hunting and fishing in the national river. The Secretary may close certain zones or times for safety or wildlife reasons. West Virginia keeps its normal authority over fish and wildlife.
The Secretary must let people hunt and fish on the lands and waters the Secretary controls inside the national river, following applicable federal and state laws. The Secretary may set aside certain zones and time periods where hunting or fishing isn't allowed, for reasons of public safety, administration, fish or wildlife management, or public use and enjoyment. Except in emergencies, the Secretary can only put these hunting and fishing rules into effect after consulting West Virginia's state agency that's responsible for hunting and fishing. The Secretary must let West Virginia carry out fish-stocking activities, in consultation with the Secretary, in waters inside the national river's boundaries. Nothing in this law changes West Virginia's authority over fish and wildlife.
The Secretary shall permit hunting and fishing on lands and waters under his jurisdiction within the boundaries of the New River Gorge National River 1 in accordance with applicable Federal and State laws, and he may designate zones where, and establish periods when, no hunting or fishing shall be permitted for reasons of public safety, administration, fish or wildlife management, or public use and enjoyment. Except in emergencies, any rules and regulations of the Secretary pursuant to this section shall be put into effect only after consultation with the appropriate State agency responsible for hunting and fishing activities. The Secretary shall permit the State of West Virginia to undertake fish stocking activities carried out by the State, in consultation with the Secretary, on waters within the boundaries of the national river. Nothing in this Act shall be construed as affecting the jurisdiction of the State of West Virginia with respect to fish and wildlife.
