Within Dayton Aviation Heritage National Historical Park, the Secretary of the Interior must acquire Hawthorn Hill, the Wright Company factory, and the Wright Cycle Company Building and Hoover Block. The Secretary may also acquire other listed properties and make cooperative agreements with government agencies and private groups. Agreements must generally let the public visit and let the Secretary make improvements after consulting the Aviation Heritage Foundation.
(a) Acquisition of properties within park: Subject to money being available, the Secretary must acquire Hawthorn Hill, the Wright Company factory, the Wright Cycle Company Building, and Hoover Block. The Secretary may also acquire other properties listed in section 410ww(b) of this title, by donation, purchase with donated or government money, exchange, or transfer.
(b) Cooperative agreements: The Secretary may make cooperative agreements with other federal agencies, state and local public bodies, and private groups and organizations, about preserving, developing, using, and interpreting properties within the park, to support their proper use and management consistent with this subchapter.
(c) Cooperative agreements: The Secretary may make a cooperative agreement with a partner or partners, including the Wright Family Foundation, to operate and run programs at Hawthorn Hill and charge reasonable fees — no matter what other laws say — to help cover the park's operating and programming costs.
(d) Conditions: Cooperative agreements, wherever appropriate, must let: (1) the public visit the property at set reasonable times to view it, its exhibits, or attend Secretary-run programs; and (2) the Secretary make improvements to the property, after consulting the Aviation Heritage Foundation, to improve public use and enjoyment of the property and its programs.
Within the boundaries of the park the Secretary shall, subject to the availability of appropriated funds, acquire Hawthorn Hill, the Wright Company factory, the Wright Cycle Company Building and Hoover Block, and may acquire other properties, or interests therein, referred to in section 410ww(b) of this title, by donation, purchase with donated or appropriated funds, exchange, or transfer.
The Secretary is authorized to enter into cooperative agreements with other Federal agencies, State and local public bodies, and private interests and organizations relating to the preservation, development, use, and interpretation of properties within the boundaries of the park in order to contribute to the appropriate use and management of such properties consistent with the purposes of this subchapter.
The Secretary is authorized to enter into a cooperative agreement with a partner or partners, including the Wright Family Foundation, to operate and provide programming for Hawthorn Hill and charge reasonable fees notwithstanding any other provision of law, which may be used to defray the costs of park operation and programming.
Cooperative agreements under this section shall provide, whenever appropriate, that—
the public may have access to any such property at specified reasonable times for purposes of viewing such property or the exhibits or attending programs established by the Secretary under this subsection; and
the Secretary may make such improvements to any such property as the Secretary deems necessary after consultation with the Aviation Heritage Foundation to enhance the public use and enjoyment of such property and programs.
