The term “coastal fishery management plan” means a plan for managing a coastal fishery resource, or an amendment to such plan, prepared and adopted by the Commission, that— (A) contains information regarding the status of the resource and related fisheries; and (B) specifies conservation and management actions to be taken by the States.;

“coastal fishery resource” applies throughout its chapter

The term “coastal fishery resource” means any fishery, any species of fish, or any stock of fish that moves among, or is broadly distributed across, waters under the jurisdiction of two or more States or waters under the jurisdiction of one or more States and the exclusive economic zone.;

The term “Commission” means the Atlantic States Marine Fisheries Commission established under the interstate compact consented to and approved by the Congress in Public Laws 77–539 and 81–721.;

The term “conservation” means the restoring, rebuilding, and maintaining of any coastal fishery resource and the marine environment, in order to assure the availability of coastal fishery resources on a long-term basis.;

“exclusive economic zone” applies throughout its chapter

The term “exclusive economic zone” means the exclusive economic zone of the United States established by Proclamation Number 5030, dated March 10, 1983 . For the purposes of this chapter, the inner boundary of that zone is a line coterminous with the seaward boundary of each of the coastal States, and the outer boundary of that zone is a line drawn in such a manner that each point on it is 200 nautical miles from the baseline from which the territorial sea is measured.;

The term “fish” means finfish, mollusks, crustaceans, and all other forms of marine animal life other than marine mammals and birds.;

“fishery” applies throughout its chapter

The term “fishery” means— (A) one or more stocks of fish that can be treated as a unit for purposes of conservation and management and that are identified on the basis of geographical, scientific, technical, commercial, recreational, or economic characteristics; or (B) any fishing for such stocks.;

“fishing” applies throughout its chapter

The term “fishing” means— (A) the catching, taking, or harvesting of fish; (B) the attempted catching, taking, or harvesting of fish; (C) any other activity that can be reasonably expected to result in the catching, taking, or harvesting of fish; or (D) any operations at sea in support of, or in preparation for, any activity described in subparagraphs (A) through (C). Such term does not include any scientific research activity or the catching, taking, or harvesting of fish in an aquaculture operation.;

“implement and enforce” applies throughout its chapter

The term “implement and enforce” means to enact and implement laws or regulations as required to conform with the provisions of a coastal fishery management plan and to assure compliance with such laws or regulations by persons participating in a fishery that is subject to such plan.;

“person” applies throughout its chapter

The term “person” means any individual (whether or not a citizen or national of the United States), any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State), and any Federal, State, local, or foreign government or any entity of any such government.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Commerce.;

“State” applies throughout its chapter

The term “State” means Maine, New Hampshire, Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Pennsylvania, Delaware, Maryland, Virginia, North Carolina, South Carolina, Georgia, Florida, the District of Columbia, or the Potomac River Fisheries Commission.

“Atlantic striped bass” applies throughout its chapter

The term “Atlantic striped bass” means members of stocks or populations of the species Morone saxatilis, which ordinarily migrate seaward of the waters described in paragraph (3)(A)(i).;

“coastal State” applies throughout its chapter

The term “coastal State” means— (A) Pennsylvania and each State of the United States bordering on the Atlantic Ocean north of the State of South Carolina; (B) the District of Columbia; and (C) the Potomac River Fisheries Commission established by the Potomac River Compact of 1958.;

“coastal waters” applies throughout its chapter

The term “coastal waters” means— (A) for each coastal State referred to in paragraph (4)(A)— (i) all waters, whether salt or fresh, of the coastal State shoreward of the baseline from which the territorial sea of the United States is measured; and (ii) the waters of the coastal State seaward from the baseline referred to in clause (i) to the inner boundary of the exclusive economic zone; (B) for the District of Columbia, those waters within its jurisdiction; and (C) for the Potomac River Fisheries Commission, those waters of the Potomac River within the boundaries established by the Potomac River Compact of 1958.;

“Commission” applies throughout its chapter

The term “moratorium period” means the period beginning on the day on which moratorium is declared under section 5154(a) of this title regarding a coastal State and ending on the day on which the Commission notifies the Secretaries that that State has taken appropriate remedial action with respect to those matters that were the case of the moratorium being declared.;

The term “Plan” means a plan for managing Atlantic striped bass, or an amendment to such plan, that is prepared and adopted by the Commission.;

“high seas” applies throughout its chapter

The term “high seas” means the waters beyond the territorial sea or exclusive economic zone (or the equivalent) of any nation, to the extent that such territorial sea or exclusive economic zone (or the equivalent) is recognized by the United States.;

“high seas fishing vessel” applies throughout its chapter

The term “high seas fishing vessel” means any vessel of the United States or subject to the jurisdiction of the United States used or intended for use— (A) on the high seas; (B) for the purpose of the commercial exploitation of living marine resources; and (C) as a harvesting vessel, as a mother ship, or as any other support vessel directly engaged in a fishing operation.;

“international conservation and management measures” applies throughout its chapter

The term “international conservation and management measures” means measures to conserve or manage one or more species of living marine resources that are adopted and applied in accordance with the relevant rules of international law, as reflected in the 1982 United Nations Convention on the Law of the Sea, and that are recognized by the United States. Such measures may be adopted by global, regional, or sub-regional fisheries organizations, subject to the rights and obligations of their members, or by treaties or other international agreements.;

“length” applies throughout its chapter

The term “length” means— (A) for any high seas fishing vessel built after July 18, 1982 , 96 percent of the total length on a waterline at 85 percent of the least molded depth measured from the top of the keel, or the length from the foreside of the stem to the axis of the rudder stock on that waterline, if that is greater, except that in ships designed with a rake of keel the waterline on which this length is measured shall be parallel to the designed waterline; and (B) for any high seas fishing vessel built before July 18, 1982 , registered length as entered on the vessel’s documentation.;

“person” applies throughout its chapter

The term “person” means any individual (whether or not a citizen or national of the United States), any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State), and any Federal, State, local, or foreign government or any entity of any such government.;

The term “National Coral Reef Resilience Strategy” means the National Coral Reef Resilience Strategy in effect under section 6403 of this title . (17) Native entity

The term “resilience” means the capacity for corals within their native range, coral reefs, or coral reef ecosystems to resist and recover from natural and human disturbances, and maintain structure and function to provide coral reef ecosystem services, as determined by clearly identifiable, measurable, and science-based standards. “restoration” applies throughout its chapter

The term “restoration” means the use of methods and procedures necessary to enhance, rehabilitate, recreate, or create a functioning coral reef or coral reef ecosystem, in whole or in part, within suitable waters of the historical geographic range of such ecosystems, to provide ecological, economic, cultural, or coastal resiliency services associated with healthy coral reefs and benefit native populations of coral reef organisms.
