Before first United States distribution of certain devices, manufacturers, importers, distributors, and interested copyright parties may jointly ask the Copyright Royalty Judges to decide specified questions. This section sets procedures for the proceeding, stays related lawsuits, and appeals.

(a) Scope of Determination. Before the first distribution in the United States of a digital audio recording device or digital audio interface device, a party that makes, imports, or distributes the device and any interested copyright party may agree to ask the Copyright Royalty Judges to decide whether the device is covered by section 1002 or how royalty payments for it must be made under section 1003. (b) Initiation of Proceedings. The parties must file a petition asking the Judges to begin a proceeding. Within 2 weeks after receiving it, the Chief Copyright Royalty Judge must arrange for notice of the proceeding’s start to be published in the Federal Register. (c) Stay of Judicial Proceedings. If a party to this proceeding applies, any civil lawsuit under section 1009 against a party to the proceeding must be paused until the proceeding ends. (d) Proceeding. The Judges must conduct the proceeding under procedures they may adopt. They must decide it from a fully documented written record. Any party may submit relevant information and proposals. Each party must pay its own participation costs. (e) Judicial Review. A party may appeal a determination under subsection (d) as section 803(d) of this title provides. The appeal does not pause the Judges’ determination. If a court changes the determination, it has jurisdiction to enter its own decision consistent with its final judgment. The court may also cancel the determination and send the case back for proceedings under this section.
