This section punishes certain conspiracies carried out from within United States jurisdiction to commit murder, kidnapping, or maiming abroad. It also punishes conspiracies to damage specified foreign property or public structures when a conspirator takes an act in United States jurisdiction to advance the conspiracy.
(a) Conspiracy to murder, kidnap, or maim.
(1) A person within United States jurisdiction who conspires with one or more people, wherever those people are, to commit outside the United States an act that would be murder, kidnapping, or maiming if committed in the United States' special maritime and territorial jurisdiction is covered by this paragraph if one conspirator acts within United States jurisdiction to carry out an objective of the conspiracy.
(2) The punishment is:
(A) For conspiracy to murder or kidnap, imprisonment for any number of years or for life; and
(B) For conspiracy to maim, imprisonment for not more than 35 years.
(b) Conspiracy to damage foreign property. A person within United States jurisdiction who conspires with one or more people, wherever they are, to damage or destroy specific property in a foreign country is covered if the property belongs to a foreign government or one of its political subdivisions with which the United States is at peace, or is a railroad, canal, bridge, airport, airfield, other public utility, public conveyance, public structure, or religious, educational, or cultural property located there. If one conspirator acts within United States jurisdiction to carry out an objective of the conspiracy, the person shall be imprisoned for not more than 25 years. This section does not define “special maritime and territorial jurisdiction,” “in aid,” or “at peace.”
Whoever, within the jurisdiction of the United States, conspires with one or more other persons, regardless of where such other person or persons are located, to commit at any place outside the United States an act that would constitute the offense of murder, kidnapping, or maiming if committed in the special maritime and territorial jurisdiction of the United States shall, if any of the conspirators commits an act within the jurisdiction of the United States to effect any object of the conspiracy, be punished as provided in subsection (a)(2).
The punishment for an offense under subsection (a)(1) of this section is—
imprisonment for any term of years or for life if the offense is conspiracy to murder or kidnap; and
imprisonment for not more than 35 years if the offense is conspiracy to maim.
Whoever, within the jurisdiction of the United States, conspires with one or more persons, regardless of where such other person or persons are located, to damage or destroy specific property situated within a foreign country and belonging to a foreign government or to any political subdivision thereof with which the United States is at peace, or any railroad, canal, bridge, airport, airfield, or other public utility, public conveyance, or public structure, or any religious, educational, or cultural property so situated, shall, if any of the conspirators commits an act within the jurisdiction of the United States to effect any object of the conspiracy, be imprisoned not more than 25 years.
