submitted 18 years ago by Pub. L. 110-437 to r/title-2-THE-CONGRESS · 411 words · no verdicts yet
On the transfer date, specified contracts, liabilities, records, property, appropriations, other assets and interests, and employees of the Capitol Guide Service move to the Office of Congressional Accessibility Services. The transferred employees remain under the Director's authority and receive the stated protections and retirement treatment.
(a) Transfer of authorities and personnel. On the transfer date*, the Congressional Special Services Office of the Capitol Guide Service's contracts, liabilities, records, property, appropriations, other assets and interests, and employees transfer to the Office of Congressional Accessibility Services established under section 2172(a), as amended by section 2251. Any appropriated amounts that are still available on that date transfer only if the Appropriations Committees of the House and Senate approve. The employees are subject to the direction, supervision, and control of the Director of Accessibility Services.
(b) Treatment of employees at the time of transfer. (1) General rule. A person who is a non-temporary employee of the Capitol Guide Service Office on the transfer date and is transferred under subsection (a) is subject to the Director's authority under section 2172(b), as amended by section 2251. The person's grade, pay, leave rate, and other benefits in effect at the time of transfer may not be reduced while the person remains continuously employed in the same position in the Office of Congressional Accessibility Services, except for cause.
(2) Eligibility for immediate retirement based on involuntary separation. For sections 8336(d) and 8414(b) of title 5, a person described in paragraph (1) who separates from service with the Office is treated as having separated involuntarily if, at the time of separation, the person has either (A) completed 25 years of service under title 5, or (B) completed 20 years of service under title 5 and is at least 50 years old.
(3) No probationary period. The Director may not impose a probationary period on a person transferred to the Office under subsection (a).
In accordance with the provisions of this subchapter, effective on the transfer date*—
the contracts, liabilities, records, property, appropriations, and other assets and interests of the Congressional Special Services Office of the Capitol Guide Service, and the employees of such Office, are transferred to the Office of Congressional Accessibility Services established under section 2172(a) of this title (as amended by section 2251 of this title), except that the transfer of any amounts appropriated to the Congressional Special Services Office that remain available as of the transfer date shall occur only upon the approval of the Committees on Appropriations of the House of Representatives and Senate; and
the employees of such Office shall be subject to the direction, supervision, and control of the Director of Accessibility Services.
Any individual who is an employee of the Congressional Special Services Office of the Capitol Guide Service on a non-temporary basis on the transfer date who is transferred under subsection (a) shall be subject to the authority of the Director of Accessibility Services under section 2172(b) of this title (as amended by section 2251 of this title), except that the individual’s grade, compensation, rate of leave, or other benefits that apply with respect to the individual at the time of transfer shall not be reduced while such individual remains continuously so employed in the same position within the Office of Congressional Accessibility Services established under section 2172(a) of this title (as amended by section 2251 of this title), other than for cause.
For purposes of section 8336(d) and section 8414(b) of title 5, an individual described in paragraph (1) who is separated from service with the Office of Congressional Accessibility Services shall be considered to have separated from the service involuntarily if, at the time the individual is separated from service—
the individual has completed 25 years of service under such title; or
