2 U.S.C. § 4501 — Compensation of Members of Congress
submitted 80 years ago by ch. 753 to r/title-2-THE-CONGRESS · 292 words · no verdicts yet
This section sets the annual pay rates for Members of Congress and certain congressional leaders. It ties adjustments to Federal employee pay changes, limits the adjustment to the applicable General Schedule increase, and rounds the result to $100.
(1) The annual pay rate for each Senator, House Member, House Delegate, and Puerto Rico Resident Commissioner; for the Senate President pro tempore and Senate and House majority and minority leaders; and for the Speaker of the House is the rate for that position under chapter 11 of this title, adjusted under paragraph (2). (2)(A) At the start of the first applicable pay period on or after the month in which General Schedule pay is adjusted under section 5303 of title 5, each rate is adjusted by the percentage corresponding to the latest change in the Employment Cost Index, determined under section 704(a)(1) of the Ethics Reform Act of 1989, using the first day of the fiscal year in which the General Schedule adjustment takes effect as the comparison date. The dollar adjustment is rounded to the nearest $100, or upward to the next $100 if exactly halfway. (B) Before rounding, the adjustment in any calendar year cannot exceed that year's General Schedule percentage adjustment under section 5303 of title 5.
The annual rate of pay for—
each Senator, Member of the House of Representatives, and Delegate to the House of Representatives, and the Resident Commissioner from Puerto Rico,
the President pro tempore of the Senate, the majority leader and the minority leader of the Senate, and the majority leader and the minority leader of the House of Representatives, and
the Speaker of the House of Representatives,
shall be the rate determined for such positions under chapter 11 of this title, as adjusted by paragraph (2) of this section.
Subject to subparagraph (B), effective at the beginning of the first applicable pay period commencing on or after the first day of the month in which an adjustment takes effect under section 5303 of title 5 in the rates of pay under the General Schedule, each annual rate referred to in paragraph (1) shall be adjusted by an amount, rounded to the nearest multiple of $100 (or if midway between multiples of $100, to the next higher multiple of $100), equal to the percentage of such annual rate which corresponds to the most recent percentage change in the ECI (relative to the date described in the next sentence), as determined under section 704(a)(1) of the Ethics Reform Act of 1989. The appropriate date under this sentence is the first day of the fiscal year in which such adjustment in the rates of pay under the General Schedule takes effect.
In no event shall the percentage adjustment taking effect under subparagraph (A) in any calendar year (before rounding), in any rate of pay, exceed the percentage adjustment taking effect in such calendar year under section 5303 of title 5 in the rates of pay under the General Schedule.
