20 U.S.C. § 6397 — Bypass

The Secretary may bypass a State and arrange for a public or private agency to run the program if the State cannot or will not do so, or if the arrangement would be more efficient or improve student achievement.
The Secretary may use all or part of a State’s allocation to arrange with a public or private agency to carry out this part in the State if the Secretary finds that (1) the State cannot or will not conduct migratory-child education programs, (2) the arrangement would administer them more efficiently and economically, or (3) it would substantially improve the children’s educational achievement.
The Secretary may use all or part of any State’s allocation under this part to make arrangements with any public or private agency to carry out the purpose of this part in such State if the Secretary determines that—
the State is unable or unwilling to conduct educational programs for migratory children;
such arrangements would result in more efficient and economic administration of such programs; or
such arrangements would add substantially to the educational achievement of such children.
