20 U.S.C. § 80t–5 — Building

(a) Location: (1) Within 2 years after December 27, 2020, the Board of Regents had to designate a site for the Museum. (2) In choosing a site, the Board had to (A) pick a location in Washington, D.C., and (B) consider these sites: (i) the "South Monument site" on the National Mall, bordered by 14th Street NW, Jefferson Drive SW, Raoul Wallenberg Place SW, and Independence Ave SW; and (ii) the Northwest United States Capitol site, bordered by 3rd Street NW, Constitution Avenue NW, 1st Street NW, and Pennsylvania Ave NW. (3) The Board had to weigh: (A) estimated costs for each potential site; (B) each site's suitability, including size, proximity to other buildings and transportation, and other conditions; and (C) the Congressional Commission's recommendations. (4) The Board had to consult: (A) the Chair of the National Capital Planning Commission; (B) the Director of the National Park Service; (C) the Chair of the National Capital Memorial Advisory Commission; (D) the Chair of the Commission on Fine Arts; (E) the Chair of the Congressional Commission; (F) the Architect of the Capitol; and (G) the chair and ranking member of the Senate Rules and Administration Committee, House Administration Committee, Senate Energy and Natural Resources Committee, House Natural Resources Committee, House Transportation and Infrastructure Committee, House Appropriations Committee, and Senate Appropriations Committee. (5) Congress intended the Museum to be located on or near the National Mall as much as practical. (b) Site under another agency's control: (1) The Board cannot designate a site under another federal agency's control unless that agency's head sends written notice to each committee listed in (a)(4)(G), agreeing to let the Museum use that land or structure. (2) As soon as practical after Congress receives that notice, the agency must transfer administrative control of the land or structure to the Smithsonian. (c) Construction: The Board of Regents, working with the council under section 80t–2, may plan, design, and build the Museum's building at the designated site, following this section. (d) Commemorative Works Act: Chapter 89 of title 40 does not apply to the Museum, except the Museum still cannot be located in "the Reserve," as defined in section 8902(a) of that title. (e) Cost sharing: The Board of Regents pays: (1) 50 percent of this section's costs from federal funds; and (2) 50 percent from non-federal sources.
