20 U.S.C. § 76h — Board of Trustees

(a)(1) In general: This subsection creates, within the Smithsonian Institution, a bureau directed by a board called the Trustees of the John F. Kennedy Center for the Performing Arts (called the "Board" in this subchapter). The Board's job is to maintain and run the John F. Kennedy Center for the Performing Arts and its site as the National Center for the Performing Arts — a living memorial to John Fitzgerald Kennedy — and to carry out whatever other duties this subchapter gives it. (2) Membership: The Board is made up of: (A) the Secretary of Health and Human Services; (B) the Librarian of Congress; (C) the Secretary of State; (D) the Chairman of the Commission of Fine Arts; (E) the Mayor of the District of Columbia; (F) the Superintendent of D.C. Schools; (G) the Director of the National Park Service; (H) the Secretary of Education; (I) the Secretary of the Smithsonian Institution; (J) the Speaker and Minority Leader of the House, the chairman and ranking minority member of the House Committee on Transportation and Infrastructure, and three more House members the Speaker appoints; (K) the Majority and Minority Leaders of the Senate, the chairman and ranking minority member of the Senate Committee on Environment and Public Works, and three more Senators the President of the Senate appoints; and (L) thirty-six general trustees, who must be U.S. citizens, appointed under (b). (b) General trustees: The President appoints the 36 general trustees. Each serves a six-year term, except: (1) someone appointed to fill a vacancy before a term ends serves only the rest of that term; (2) a trustee keeps serving until a successor is appointed; and (3) for members appointed before July 21, 1994, the term expires as set at the time of appointment. (c) Advisory Committee on the Arts: There is also an Advisory Committee on the Arts, whose members the President appoints and who serve at the President's pleasure. Members — who may include federal officers or employees — must be recognized for their knowledge, experience, or interest in one or more of the arts covered by the Kennedy Center. The President names the Committee's Chairman, considering recommendations from leading national arts organizations. The Committee advises and consults with the Board and makes recommendations about the Center's cultural activities, and it helps the Board carry out section 76k(a) of this title. Committee members serve without pay.
