20 U.S.C. § 76i — John F. Kennedy Center for the Performing Arts

(a) In general: The Board must build, for the Smithsonian Institution, a building called the John F. Kennedy Center for the Performing Arts, using funds raised through voluntary contributions — not appropriated government money. It sits on a Washington, D.C. site bounded by the Inner Loop Freeway on the east, the Theodore Roosevelt Bridge approaches on the south, Rock Creek Parkway on the west, and New Hampshire Avenue and F Street on the north — a site chosen by the National Capital Planning Commission. That Commission must acquire, by purchase, condemnation, or other means, whatever land is needed for the Center and related facilities. The building's design must follow plans the Commission of Fine Arts approves. (b) Parking garage additions and site improvements: (1) Following a specific 1997 site plan, the Board may design and build an addition to the parking garage at each end (north and south) of the Center, plus site improvements and modifications. (2) That plan must be on file and available for public inspection in the Center's Secretary's office. (3) No appropriated (government) funds may pay for: (A) building the garage additions; (B) site improvements the Board specifically designates as funded from non-appropriated sources; or (C) buying large-screen theater equipment or producing an interpretive film, if the Board designates those as funded from non-appropriated sources. (c) Expansion project: (1)(A) Subject to this subsection's requirements, the Board may take whatever steps are needed to build the "expansion project" (defined below). (B) The Board is responsible for planning, designing, engineering, and constructing it. (C) All this work must stay within the Center's mission as the national center for the performing arts, and the costs must be paid only with non-appropriated (non-government) funds. (2) Before awarding a construction contract, the Board must estimate any extra annual operating and maintenance costs (or savings) the project would create, and must account for those costs in its budget requests for fiscal year 2014 and later. The Board must base its final decision on whether to proceed on whether it can absorb those extra costs alongside its other budget priorities. (3) The Board may acknowledge private contributions used for the expansion project on the interior of the building, but not on the exterior — consistent with section 76j(b) of this title's rules. (4) The "expansion project" means an addition to the south end of the Center's building that is under 100,000 square feet, that improves the Center's accessibility and education functions as they existed on June 8, 2012, and that becomes part of the Center's existing structure as of that date.
