20 U.S.C. § 7913 — Prohibition on discrimination

This chapter cannot be used to let the Secretary, a state, or a school discriminate against a student in violation of the Constitution or other anti-discrimination law covering federally funded programs.
This section is a single, undivided rule. Nothing in this chapter lets the Secretary, or a state or local education agency, or a school, give a student a benefit — or deny or impose a burden on a student — in a way that breaks the Fifth or Fourteenth Amendments to the Constitution, or any other law against discrimination in federally funded programs.
Nothing in this chapter shall be construed to require, authorize, or permit, the Secretary, or a State educational agency, local educational agency, or school to grant to a student, or deny or impose upon a student, any financial or educational benefit or burden, in violation of the fifth or 14th amendments to the Constitution or other law relating to discrimination in the provision of federally funded programs or activities.
