submitted 24 years ago by Pub. L. 89-10 to r/title-20-EDUCATION · 147 words · no verdicts yet
States that get federal school funding must, within two years of January 8, 2002, assure the Secretary they have a process for transferring a student's suspension or expulsion records between schools. This rule does not cover records transferred from private or parochial schools.
(a) Nonapplication of provisions. This section doesn't cover disciplinary records for a suspension or expulsion that come from a private, parochial, or other nonpublic school or organization providing education below college level.
(b) Disciplinary records. Following the Family Educational Rights and Privacy Act of 1974, each state getting federal funds under this chapter must, within two years of January 8, 2002, assure the Secretary it has a procedure. That procedure must let local school districts transfer a student's suspension or expulsion records to any public or private elementary or secondary school the student enrolls in, or plans, intends, or is told to enroll in, full-time or part-time.
This section shall not apply to any disciplinary records with respect to a suspension or expulsion that are transferred from a private, parochial or other nonpublic school, person, institution, or other entity, that provides education below the college level.
In accordance with the Family Educational Rights and Privacy Act of 1974 (20 U.S.C. 1232g), not later than 2 years after January 8, 2002, each State receiving Federal funds under this chapter shall provide an assurance to the Secretary that the State has a procedure in place to facilitate the transfer of disciplinary records, with respect to a suspension or expulsion, by local educational agencies to any private or public elementary school or secondary school for any student who is enrolled or seeks, intends, or is instructed to enroll, on a full- or part-time basis, in the school.
