This chapter does not let the Secretary control school administration or budgets, and the Secretary must follow federal rulemaking procedures and consider stakeholder input before issuing regulations or guidance. This rule doesn't limit any authority the Secretary already has under other federal laws.
(a) Rule of construction. This chapter does not let the Secretary govern or control school administration — including how schools develop and spend their budgets — unless this chapter specifically authorizes that. The Secretary also can't issue a regulation without first following the rulemaking procedures in section 553 of title 5, and can't issue nonregulatory guidance without first considering stakeholder input, as far as that's practical.
(b) Authority under other law. Nothing in (a) limits any authority the Secretary has under any other federal law.
Nothing in this chapter shall be construed to allow the Secretary to—
exercise any governance or authority over school administration, including the development and expenditure of school budgets, unless otherwise authorized under this chapter;
issue any regulation without first complying with the rulemaking requirements of section 553 of title 5; or
issue any nonregulatory guidance without first, to the extent feasible, considering input from stakeholders.
Nothing in subsection (a) shall be construed to affect any authority the Secretary has under any other Federal law.
