This chapter does not let the Secretary stop a child from walking, biking, or riding to school with parental permission, and does not expose parents to legal trouble for letting their child travel to school in a way the parents consider age-appropriate. This rule does not override state or local law.
(a) In general. Except as subsection (b) limits, nothing in this chapter authorizes the Secretary — or should be read — to stop a child from traveling to and from school on foot, by bike, car, or bus, when that child's parents have given permission. Nor does anything here expose parents to civil or criminal charges for letting their child travel to and from school in a way the parents believe is responsible, safe, and age-appropriate.
(b) No preemption of State or local laws. Despite subsection (a), this section does not override any state or local law.
Subject to subsection (b), nothing in this chapter shall authorize the Secretary to, or shall be construed to—
prohibit a child from traveling to and from school on foot or by car, bus, or bike when the parents of the child have given permission; or
expose parents to civil or criminal charges for allowing their child to responsibly and safely travel to and from school by a means the parents believe is age appropriate.
Notwithstanding subsection (a), nothing in this section shall be construed to preempt State or local laws.
