Congress finds that this chapter prohibits the Federal Government from controlling certain State and local education decisions and from funding a federally sponsored national test in any subject without specific and explicit legal authorization. Congress says States and local educational agencies retain responsibility for curriculum, instruction, and assessments.
This section has two parts: findings in subsection (a), and an opinion in subsection (b).
(a) Findings. Congress states two facts about what this chapter (the larger education law) does.
(1) The federal government cannot force a state, a local school district, or a school to use a certain curriculum, program of instruction, or way of spending its own money. The federal government also cannot make a state spend money or take on costs that this chapter does not pay for.
(2) The federal government cannot pay for creating, testing, running, or handing out any federally sponsored national test in reading, math, or any other subject — unless a law specifically and clearly allows it.
(b) Sense of Congress. This subsection is Congress's opinion, not a binding rule. Congress believes that states and local school districts, not the federal government, should decide their own curriculum, instruction programs, and how they assess students in kindergarten through 12th grade.
The Congress finds as follows:
This chapter prohibits the Federal Government from mandating, directing, or controlling a State, local educational agency, or school’s curriculum, program of instruction, or allocation of State and local resources, and from mandating a State or any subdivision thereof to spend any funds or incur any costs not paid for under this chapter.
This chapter prohibits the Federal Government from funding the development, pilot testing, field testing, implementation, administration, or distribution of any federally sponsored national test in reading, mathematics, or any other subject, unless specifically and explicitly authorized by law.
It is the sense of the Congress that States and local educational agencies retain the rights and responsibilities of determining educational curriculum, programs of instruction, and assessments for elementary and secondary education.
