20 U.S.C. § 7929 — Analysis and periodic review of departmental guidance

The Secretary must set up rules for reviewing important guidance documents. These rules must cover how documents get approved, listed, and reviewed. The public must also be able to ask for changes.
The Secretary of Education must create written procedures for handling "significant guidance documents." These are important documents the Department issues to explain how it applies the law. The procedures must include four things.
(1) Approval processes. The Department must have a clear process inside itself for approving these documents before they go out.
(2) Identification. Each document must clearly say which office issued it, what activities it covers, who it applies to, and the date it was issued.
(3) Public list. The Department must keep a public list of significant guidance documents that were issued, changed, or taken back within the last year. Anyone can see this list.
(4) Public request. The public must have a way to ask the Department to change or cancel an existing significant guidance document.
Together, these four requirements are meant to make sure guidance documents are reviewed carefully, are easy to find, and can be challenged by the public.
The Secretary shall develop procedures for the approval and periodic review of significant guidance documents that include—
appropriate approval processes within the Department;
appropriate identification of the agency or office issuing the documents, the activities to which and the persons to whom the documents apply, and the date of issuance;
a publicly available list to identify those significant guidance documents that were issued, revised, or withdrawn within the past year; and
an opportunity for the public to request that an agency modify or rescind an existing significant guidance document.
