This subpart started 90 days after January 8, 2002. It covers any claim filed on or after that date. It doesn't matter when the underlying harm or conduct actually happened.
(a) When it started. This subpart took effect 90 days after January 8, 2002 — the date the No Child Left Behind Act of 2001 was enacted.
(b) Which claims it covers. This subpart applies to any claim that a teacher's act or omission caused harm*, as long as that claim was filed on or after this effective date. It does not matter whether the harm itself, or the conduct that caused it, happened before or after that date — what matters is only the filing date of the claim.
This subpart shall take effect 90 days after January 8, 2002.
This subpart applies to any claim for harm* caused by an act or omission of a teacher* if that claim is filed on or after the effective date of the No Child Left Behind Act of 2001 without regard to whether the harm that is the subject of the claim or the conduct that caused the harm occurred before such effective date.
