20 U.S.C. § 80q–4 — Director and staff of National Museum

(a) In general: The Secretary of the Smithsonian Institution must appoint: (1) a Director, who manages the National Museum^* subject to the Board of Trustees' policies; and (2) other National Museum employees, who serve under the Director.
(b) Offering jobs to Heye Foundation employees: Every person employed by the Heye Museum^* on the day before the Heye Foundation assets^* transfer to the Smithsonian must be offered a job with the Smithsonian, (1) on the usual terms for that kind of job, and (2) at a pay rate at least as high as what they earned the day before the transfer.
(c) Civil-service rules: The Secretary may: (1) appoint the Director, 2 employees under (a)(2), and the employees under (b) without following title 5's normal competitive-service appointment rules; (2) set the pay of the Director and those 2 employees without following title 5's job-classification and General Schedule pay-rate rules; and (3) set the pay of the employees under (b) following the normal classification and General Schedule rules, but still subject to the pay floor in (b)(2).
