(4) Population determination For the purposes of this section, population shall be determined by the Secretary on the basis of the latest estimates available to the Department of Education. (d) Definition of State For the purpose of this section,

the term “qualifying State” means a State (except the United States Virgin Islands) that, for the fiscal year for which a determination under this paragraph is made, would receive, under the allotment formula under paragraph (3) (without the application of this paragraph), an amount that would be less than the amount the State would receive under subparagraph (A) for such fiscal year. the term “nonprofit elementary or secondary school” means— (A) any elementary or secondary school (as defined in section 198(a)(7) 1 of the Elementary and Secondary Education Act of 1965) owned and operated by one or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual, and (B) any school of any agency of the United States;

school buildings applies throughout its chapter

the term “school buildings” means— (A) structures suitable for use as classrooms, laboratories, libraries, school eating facilities, or facilities used for the preparation of food; (B) any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education; (C) other facilities used for the instruction of students, for research, or for the administration of educational or research programs; and (D) maintenance, storage, or utility facilities essential to the operation of the facilities described in subparagraphs (A) through (C) of this paragraph;

The term “Attorney General” means the Attorney General of the United States.;

The term “threat” or “hazard” means that an asbestos material is friable or easily damaged, or within reach of students or employees or otherwise susceptible to damage (including damage from water, vibration, or air circulation) which could result in the dispersal of asbestos fibers into the school environment.;

local educational agency applies throughout its subchapter

The term “local educational agency” means— (A) any local educational agency as defined in section 7801 of this title ; and (B) the governing authority of any nonprofit elementary or secondary school.;

nonprofit elementary or secondary school applies throughout its subchapter

The term “nonprofit elementary or secondary school” means— (A) any elementary school or secondary school as defined in section 7801 of this title owned and operated by one or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual; and (B) any school of any agency of the United States.;

response action applies throughout its subchapter

The term “response action” has the meaning given such term by section 2642(11) of title 15 .

school buildings applies throughout its subchapter

The term “school buildings” means— (A) structures suitable for use as classrooms, laboratories, libraries, school eating facilities, or facilities used for the preparation of food; (B) any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education; (C) other facilities used for the instruction of students, for research, or for the administration of educational or research programs; and (D) maintenance, storage, or utility facilities essential to the operation of the facilities described in subparagraphs (A) through (C) of this paragraph.;

State applies throughout its subchapter

The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and the Bureau of Indian Affairs.;

threat applies throughout its subchapter

The term “noninstructional time” means time set aside by the school before actual classroom instruction begins or after actual classroom instruction ends.

secondary school applies throughout its subchapter

The term “secondary school” means a public school which provides secondary education as determined by State law.;

sponsorship applies throughout its subchapter

The term “sponsorship” includes the act of promoting, leading, or participating in a meeting. The assignment of a teacher, administrator, or other school employee to a meeting for custodial purposes does not constitute sponsorship of the meeting.;

construction applies throughout its chapter

The term “construction” includes construction and initial equipment of new buildings, and expansion, remodeling, and alteration of existing buildings and equipment therein, including architect’s services, but excluding off-site improvements.;

institution of higher education applies throughout its chapter

The term “institution of higher education” means an educational institution in any State which (A) admits as regular students only individuals having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate; (B) is legally authorized within such State to provide a program of education beyond secondary education; (C) provides an educational program for which it awards a bachelor’s degree; (D) includes one or more professional or graduate schools; (E) is a public or nonprofit private institution; and (F) is accredited by a nationally recognized accrediting agency or association.

international student applies throughout its chapter

The term “international student” means an individual who— (A) is not a citizen or national of, or lawfully admitted for permanent residence in, the United States; (B) does not provide evidence from the Immigration and Naturalization Service that he or she is in the United States for other than temporary purposes with the intention of becoming a citizen of, or lawfully admitted for permanent residence in, the United States; and (C) is not lawfully admitted for permanent residence in American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, or the Virgin Islands.;

NTID applies throughout its chapter

The term “NTID” means the National Technical Institute for the Deaf.;

Secretary applies throughout its chapter

The term “Secretary” means the Secretary of Education.;

State applies throughout its chapter

The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, and the Commonwealth of the Northern Mariana Islands.;

University applies throughout its chapter

The term “University” means Gallaudet University.

Federal endowment fund applies in that section

The term “Federal endowment fund” means a fund, or a tax-exempt foundation, established and maintained pursuant to this section by the University or NTID, as the case may be, for the purpose of generating income for the support of the institution involved. (3) The term “income”, with respect to a Federal endowment fund under this section, means an amount equal to the dividends and interest accruing from investments of the corpus of such fund.;

The term “institution involved” means the University or NTID, as the case may be. (h) Authorization of appropriations (1) In the case of the University, there are authorized to be appropriated for the purposes of this section such sums as may be necessary for each of the fiscal years 2009 through 2014. (2) In the case of NTID, there are authorized to be appropriated for the purposes of this section such sums as may be necessary for each of the fiscal years 2009 through 2014. (3) Amounts appropriated under paragraph (1) or (2) shall remain available until expended. (i) Effective date The provisions of this section shall take effect as if included in this chapter as enacted on August 4, 1986 .

The term “eligible person” means— (A) a permanent resident alien of the United States; (B) a citizen or national of the United States; (C) a citizen of the Republic of the Marshall Islands, the Federal States of Micronesia, or the Republic of Palau; or (D) any person who may be admitted to lawfully engage in occupations and establish residence as a nonimmigrant in the United States as permitted under the Compact of Free Association agreements with the Republic of the Marshall Islands, the Federal States of Micronesia, or the Republic of Palau.
