22 U.S.C. § 277f — Valley Gravity Canal and Storage Project

The Secretary of State, with the President's approval, decides which features of the Valley Gravity Canal and Storage Project are international in character, and can order changes to the project's general plan for those features. The Boundary Commission's American section builds those features, after consulting the Bureau of Reclamation on general design, and operates and maintains them if the Secretary decides that's necessary because of their international nature. Building, running, and maintaining the project follows normal federal reclamation law, except: (1) beyond the flood-control or navigation allocation the Secretary of the Interior can make under section 485h(b) of title 43, the President — after talking with the Secretaries of State and Interior — can set aside part of the project's estimated total cost to protect American interests from drought caused by the unregulated Rio Grande below Fort Quitman, Texas; the same legal rules that apply to flood-control allocations apply here too, as far as they fit; and (2) all money the United States earns from building, running, and maintaining the project goes to the Treasury as miscellaneous receipts.
