22 U.S.C. § 8424 — Pakistan Counterinsurgency Capability Fund

(a) For fiscal year 2010, the Pakistan Counterinsurgency Capability Fund at the State Department gets its money from two sources: amounts Congress appropriates specifically for this purpose (not counting money for the broader assistance program in subchapter I), and any other money already available to the Secretary of State for this purpose. The Secretary of State, with the Secretary of Defense's agreement, can use this money to build and maintain Pakistan's counterinsurgency capability, under the same terms that applied to the Fund in fiscal year 2009. The Secretary of State can transfer money from this Fund to the Defense Department's own Pakistan Counterinsurgency Fund, and can transfer it back if the Secretary of Defense — with the Secretary of State's agreement — decides it isn't needed there anymore. Once transferred to the Defense Department's fund, the money gets combined with it and follows that fund's rules, subject to the payment restrictions and waiver process in section 8423(d) and (e) of this title. This transfer authority adds to, rather than replaces, any other authority to help foreign countries. The Secretary of State must notify the appropriate congressional committees in writing, in detail, at least 15 days before making any such transfer. (b) Any notice required by this section can be sent in classified or unclassified form, as needed. (c) "Appropriate congressional committees" means the House Appropriations, Armed Services, and Foreign Affairs committees, and the Senate Appropriations, Armed Services, and Foreign Relations committees.
