23 U.S.C. § 609 — Reports to Congress

(a) In general. On June 1, 2012, and every two years afterward, the Secretary^* must give Congress a report summarizing the financial performance of projects receiving or having received TIFIA assistance. The report must recommend whether the program is best served by (1) continuing under the Secretary; (2) creating a Federal corporation or federally sponsored enterprise to administer it; or (3) phasing it out and relying on capital markets without Federal participation.

(b) Application process report. (1) By December 1, 2012, and annually afterward, the Secretary must report to the House Transportation and Infrastructure Committee and Senate Environment and Public Works Committee a list of all letters of interest and applications project^* sponsors submitted during the preceding fiscal year. (2)(A) For each, the report must state^*: (i) receipt date; (ii) date the sponsor was told whether the application was complete; (iii) date a revised completed application was submitted, if any; (iv) date the sponsor was told whether the project was approved; and (v) if disapproved, the reason. (B) The report must include copies of correspondence provided to the sponsor under 23 U.S.C. § 602(d).

(c) Status reports. (1) On the TIFIA website, the Secretary must publish (A) monthly, a current report on all submitted letters and applications; and (B) quarterly, a current report on all approved applications. (2) Each report must state for each project: (A) the submitting party; (B) project name; (C) receipt date; (D) estimated eligible costs; (E) credit-assistance type sought; and (F) expected fiscal year and quarter when the credit assistance will close.
