25 U.S.C. § 13d–1Standards of need as basis for general assistance payments by Bureau of Indian Affairs; ratable reductions

submitted 41 years ago by Pub. L. 99-88 to r/title-25-INDIANS · 116 words · no verdicts yet

in plain englishAI-generated · not legal advice

The Bureau of Indian Affairs sets its general assistance payments using welfare need standards. From 1985 to 1995 it used AFDC standards; after 1995 it uses the state's welfare program standards. If a state cuts its own welfare payments by a percentage, the Bureau cuts its payments in that state by the same percentage.

This section sets the yardstick the Bureau of Indian Affairs uses for general assistance payments. (1) Between April 29, 1985, and October 1, 1995, the Bureau based its payments on the Aid to Families with Dependent Children (AFDC) standards of need. (2) Starting October 1, 1995, the Bureau bases payments on the standards of need under the state program funded by Part A of Title IV of the Social Security Act — except that if a state ratably reduces its AFDC or state-program payments, the Bureau must reduce its general assistance payments in that state by that same percentage.
