The Navajo Tribe cannot participate under this subchapter. The Secretary cannot fund an institution that excludes Indian students based on tribal membership and must recover certain funds from violating institutions.
(a) Eligibility of Navajo Tribe. The Navajo Tribe is not eligible to participate under this subchapter.
(b) Discriminatory practices prohibited. (1) The Secretary* may not provide funds to an institution that denies admission to an Indian student because the student is not a member of a particular Indian tribe*, or that denies admission because the student is a member of a particular tribe. (2) The Secretary must take steps to recover any funds provided under this subchapter that remain unspent and not legally committed and that are held by an institution found to have violated paragraph (1).
The Navajo Tribe shall not be eligible to participate under the provisions of this subchapter.
The Secretary* shall not provide any funds to any institution which denies admission to any Indian student because such individual is not a member of a specific Indian tribe*, or which denies admission to any Indian student because such individual is a member of a specific tribe.
The Secretary shall take steps to recover any unexpended and unobligated funds provided under this subchapter held by an institution determined to be in violation of paragraph (1).
