25 U.S.C. § 415c — Approval of leases

This section is one rule with no lettered subsections. The Secretary of the Interior approves leases made under 25 U.S.C. §§ 415-415d. This section limits that approval power: the Secretary cannot approve any lease that contains a provision that would prevent or delay ending the federal government's trust responsibilities over the land. This limit applies for the entire term of the lease, not just at the start. A lease cannot be written in a way that locks in federal trust status, or makes it harder to end that status later, for as long as the lease runs.
